It can be used as a supplement to introductory courses in Constitutional Law, or as a text for a course in Constitutional Theory. We have organized it to correspond with the major topics covered in casebooks on Constitutional Law. There are two significant exceptions to this organizationThe first is a separate chapter devoted to the problem of interpretation. It is closely allied to the problem of judicial review, and may be addressed in conjunction with those materials. Often, however, the subject is taken up along with a particular substantive problem such as equal protection or privacy. This chapter would fit equally well in that part of a course. The other exception is the First Amendment. It is not addressed in most first-year classes, and is often the subject of a separate upper-level course. For that reason, and because an adequate treatment would require a vast amount of material, we thought it should be covered in a separate volume.
